TFCD is something that an individual model and an indivdual photographer agree on to do with the photographer normally granting rights for the model to use the images for a comp card, self-promotion or personal use. When an agency wants a photographer to create images for the agency's use topromote its models or services, that's not TFCD. That's commercial use and monetary compensation is in order. 2. From the posting: "You must have some experience working with models and must have own transportation." Meaning, that as a photographer I've invested time and effort, not to mention cash, to learn and hone my craft and skills. Those skills are not something that everybody has or can do, despite what Ashton Kutcher and his ads for a certain line of digital cameras would have you otherwise believe. Just as a skilled carpenter gets paid for his/ her experience and skills, which go beyond owning a nice hammer and circular saw, so does an experienced photographer. As the old saying goes: Inexpensive, High Quality, Quick turnaround. Pick two, you don't get all three. 3. <![CDATA[The person who put up the original posting, listed below, is on point, though a little off in one area. That is the purpose of the model release. The model release IS NOT to give permission to publish the images, rather, it is the model signing off on using her/ his likeness in a commercial/ advertising context. The images, to which the photographer as the creator holds all rights unless otherwise signed away, can license the images to be used for editorial purposes WITHOUT having a signed model release. For advertising use, a release is needed. For example: I photograph a local ballet dancer practicing and going through various routines. A few portraits are shot as well. Later on, said dancer is to perform in some sort of regional dance ensemble and XYZ Magazine is doing a story on that and would like to use the images. I can license the images to the magazine, no model release needed. It's editorial use. The issue of the magazine is published and folks from ABC Dancewear Company see the images and really like them. So much so, they'd like to use them in advertising for their new line of dance wear. For this usage, a model release is required as it's using the likeness of the person in the image to sell the product. (Though if said individual is not identifiable in any way in the image, then no model release is really needed. But, still, it's good to have for cover-your-ass purposes.) At this point in the example, there are a few things that could be done. 1. Go back to the dancer and get a model release signed. The dancer may, rightly so, ask to be compensated for his/ her likeness being used to sell dancewear. That should be included in whatever usage fee that is quoted to the company for use of the image. 2. License the image to the company as is w/ no model release. Not the smart thing to do, but it's an option. 3. License the images to the company with it specified in the contract that the company is responsible for obtaining any and all needed model releases and that you are held harmless from any resulting actions, legal or otherwise, that arise should they fail to obtain said releases. But, in the end, it's the photographer who holds the rights to the images, not the client. And use in a portfolio DOES NOT count as advertising use. It's showing examples of your work. <![CDATA[This posting is aimed at anyone seeking photographic services. Most people list that they would grant permission to the photographer to use the client's photographs in their portfolio. In fact, the photographer actually holds all the rights to any images that they shoot! Unless an arangement is made prior to the shoot and obtained in writing, no client actually owns any images! It's called Intellectual Property in favor of the photographer! When you hire a photographer, especially if it's a model shoot, the model in question must sign a release, which allows the photographer ad agency, etc. the rights to publish those images! The photographer still owns the actual art or photographs no matter what happens with them. When you go to a studio such as Olan Mills for a portrait, and you recieve the photos, there's a gold stamp with the studio name. That's there for more than advertising. It's there, so that if you decide to have copies made at Wal Mart, they know copies cannot be made because studio photos are owned by the studio and not by YOU! That would be copyright infringement! Therefor, you may wish to re-think the idea that you, the client are "allowing" the photographer permission to use any images that he or she shoots for you! In fact they already own them!]]>
