<![CDATA[Underlying the latest U.S.-Israel spat over settlements is the deeper — real — problem: There are five key actors in the Israeli-Palestinian equation today. Two of them — the Palestinian Prime Minister Salam Fayyad and the alliance of Iran, Hamas and Hezbollah — have clear strategies. These two are actually opposed, but one of them will shape Israeli-Palestinian relations in the coming years; indeed, their showdown is nearing. I hope Fayyad wins. It would be good for Israel, America and the moderate Arabs. But those three need their own strategy to make it happen. Fayyad is the most interesting new force on the Arab political stage. A former World Bank economist, he is pursuing the exact opposite strategy from Yasir Arafat. Arafat espoused a blend of violence and politics; his plan was to first gain international recognition for a Palestinian state and then build its institutions. Fayyad calls for the opposite — for a nonviolent struggle, for building noncorrupt transparent institutions and effective police and paramilitary units, which even the Israeli Army says are doing a good job; and then, once they are all up and running, declare a Palestinian state in the West Bank by 2011. The strategy of Fayyad — and his boss, President Mahmoud Abbas — is gaining momentum and is in “direct conflict with the network of resistance: Iran, Hezbollah and Hamas,” said Gidi Grinstein, the president of the Reut Institute, one of the premier Israeli policy research centers. Iran’s strategy, explains Grinstein, is simple: Destroy Israel through a combination of asymmetric warfare — like Hezbollah’s war from South Lebanon and Hamas’s from Gaza; delegitimize Israel by accusing it of war crimes when it combats Hamas and Hezbollah, who fight while nested among civilians; “religiousize” the conflict by making it Muslims versus Jews, focusing on symbols like Jerusalem; and, finally, suck Israel into “imperial overstretch,” e.g., keep Israel occupying the 2.5 million Palestinians in the West Bank, which Iran & Co. believe will lead to “Israel’s implosion.” Therefore, today, Fayyadism, which aims to replace the Israeli occupation of the West Bank with an independent Palestinian state, is the biggest threat to Iran’s strategy. So the smart thing right now would be for the other three parties to have a clear strategy to back Fayyadism. If only. ... Ever since Israel occupied the West Bank and its Palestinian population in 1967, Israelis have faced a dilemma: Do they want a Jewish state, a democratic state and state in all of the land of Israel (Israel plus the West Bank)? In this world, they can have only two out of three. Israel can be Jewish and democratic, but not if it keeps the West Bank, because the Palestinians there plus all the Israeli Arabs will eventually outnumber the Jews. It can be Jewish and keep the West Bank, but then it can’t be democratic; Arabs will be the majority. It can be democratic and keep the West Bank, but then it can’t be Jewish. I am certain that Prime Minister Bibi Netanyahu understands this, which is why he has accepted the principle of a two-state solution. But his government is an impossible mix of moderate Labor Party and hard-line religious and nationalist ideologues who actually believe Israel doesn’t have to choose two out of three but can have all three if it just hangs tough. As a result, Bibi’s government can’t ignore the U.S. and Fayyad, but neither can it move decisively to help. The columnist Nahum Barnea of the Israeli daily Yediot Ahronot compared Netanyahu “to one of those elderly drivers who straddle two lanes for fear of making a mistake, making the drivers trailing after them crazy and cause accidents. When he signals left, he turns right. When he signals right, he continues straight ahead.” Most of the pro-U.S. Arab states lack both vision and courage, so that leaves the Obama team to promote Fayyadism, which is a big idea but faces a huge structural challenge. In 2006-2007, the Palestinian political system fractured between Hamas-controlled Gaza and a West Bank controlled by Fatah, led by Abbas and Fayyad. So, today, the Palestinian Parliament may not have the unity or legitimacy to endorse any agreement with Israel. Therefore, America must figure out how to bring about a West Bank Palestinian state next to Israel in this context. It will have to happen in phases, with the first phase being establishing a Palestinian state with “provisional borders” — covering roughly all of the West Bank minus the current Israeli settlement blocs — while postponing refugees, Jerusalem and final borders to the second phase. ]]>

<![CDATA[WASHINGTON DC — The Department of Defense released an annual report on Tuesday showing an 14 percent increase in reports of sexual assault in the military over the past year, including a 16 percent increase in reported assaults occurring in combat areas, principally Iraq and Afghanistan. Related Department of Defense Report on Sexual Assault in the Military (pdf) The report said there were 3,230 reports of sexual assault filed involving service members as either victims or assailants in the fiscal year that ended in September. The Pentagon attributed the rise largely to an upward trend in the reporting of incidents, and said the jump did “not necessarily” reflect an increase in the number of incidents. The Pentagon offered no evidence that reporting rather than sexual assault itself was on the rise in the military, and there have been reports in recent years suggesting that the strains between men and women in close quarters in war zones have exacerbated the problem. But it is also true that since 2004 the Defense Department has radically changed the way it handles sexual abuse in the military, including encouraging victims to come forward, expanding access to treatment and toughening standards for prosecution. From 2007 to 2008, there was an 8 percent increase in reported assaults, with an 11 percent increase in combat areas. The Defense Department said that for the purposes of the 2009 report, “combat areas” included Saudi Arabia, Pakistan, Yemen and other countries in the Middle East and Central Asia where military men and women are serving. “One sexual assault is too many,” Kaye Whitley, the director of the Pentagon’s sexual assault prevention and response office, said in a telephone interview. The 2009 report, like previous reports, included sexual assaults by civilians on service members and by service members on civilians. But Ms. Whitley said a majority, 53 percent, were assaults by service members on other service members. Of all the assaults, Ms. Whitley said, a vast majority, 87 percent, were male on female, while 7 percent were male on male. The typical case, she said, was an assault by an 18- to 25-year-old junior enlisted male service member on a woman, with alcohol involved. In the report, sexual assault was defined as rape, sodomy and other unwanted sexual contact, including touching of private body parts. It did not include sexual harassment, which is handled by another office in the military. Ms. Whitley said that most sexual assault in the military went unreported, as it did in the general population, and that she did not believe that there was more sexual assault in the military than in the population at large. “We are recruiting from the society we serve,” she said. The report said that sexual assault was devastating to individual service members because it “destroys the human spirit,” but that it also took a serious toll on the military. “Sexual assault reverberates throughout a unit and beyond,” it said. ]]>

<![CDATA[Cuccinelli's office confirms Virginia will sue over health care A spokesman for Virginia Attorney General Ken Cuccinelli II (R) said this afternoon that Virginia will file suit against the federal government if the Democratic health care reform bill is approved by the U.S. Congress. Cuccinelli has long said he was examining the legal issues and suggested he would likely file suit. Brian Gottstein, a spokesman for the office, said this afternoon that a lawsuit is now a definite. Gottstein would provide no details of the legal rationale for such a suit, indicating the process is "still being worked out." Virginia last week became the first state in the country to pass a state bill declaring it illegal for the government to require individuals to purchase health insurance, a key part of bills under consideration on Capitol Hill. We are also expecting to receive a letter shortly that Cuccinelli is sending to House Speaker Nancy Pelosi (D-Calif.) warning her that using the so-called "deem and pass" procedure to pass the Senate health reform bill in the House would open the measure to additional constitutional challenges from the states. UPDATE: We've received a copy of Cuccinelli's letter to Pelosi. She has reportedly held odd jobs cleaning homes the last few years. Natoma was paying $5,000 a year for her insurance but dropped it after it went up to $8,000. She wrote president Obama in December to tell him about it. She was worried she might lose her home. Some people might say she’s lucky to still have a home after losing her job 12 years ago. Barack Obama came to Ohio today to prop Natoma up on stage with him. But, Natoma Canfield couldn’t make it. She is back in the hospital. <![CDATA[The House won’t vote on the Senate Bill because they cannot trust a future Bill to modify the current Senate Bill after Obama signs it into law. Nor can they do their own Bill that will only garner 59 Senate votes. So they will ignore the Parliamentarian along with the Constitution and vote, not on a Bill, but on a rule to accept the current Senate Bill with the changes they want. In effect they will vote on a rule and not a Bill thereby avoiding the Constitutionally required procedures necessary to turn a Bill into a Law. The amazing thing is that everyone wants insurance reform because of costs outpacing inflation. This insurance reform does not accomplish that. The American public is not concerned with 12-30 million uninsured people that still manage to get medical care and yet Senate democrats, such as Dick Durbin, speaking about long term dubious budget neutrality and savings, admits that insurance costs, by those that pay, will actually increase! So will taxes! The American people understand this. They also understand that the many choices and good care they currently have with their existing plans will gradually become unavailable. It is interesting that an argument for insurance reform is also based upon companies denying preexisting illnesses and yet you can count on any government program to also deny certain people, based on age and illness, specific treatments and surgery. Medicare currently denies the most and pays the least. That is why people purchase supplemental insurance. So here we have a Bill, the public does not desire because it will increase the national debt, provide less medical care at increased personal cost, nevertheless forced upon us by the authoritarian hand of the central planers using an unconstitutional process. All this because 5-10 percent of those living in America currently receiving medical care, but lacking medical insurance, justifies the theft of Constitutionally protected liberties for 90-95 percent of Americans. Third World Countries have figured this out. If this Bill becomes Law it will just be a decade or two before we not only get our manufactured goods and energy from these countries but we will also be forced to travel to them for a new emerging market that provides the medical services we used to deliver before our government confiscated our freedom to do the same for ourselves. What would the Founders have thought? Here are some examples. Let's go to Page 2069 through Page 2078 of the Senate-passed bill. It says, "If a qualified plan provides [abortion] coverage … the issuer of the plan shall not use any amount attributable to [health reform's government-funding mechanisms] for purposes of paying for such services." (This is on Page 2072.) That seems pretty straightforward. No government funding for abortions. (Except in the case of rape, incest, or a threat to the mother's life—the same exceptions granted under current law.) If a health insurer selling through the exchanges wishes to offer abortion coverage—the federal government may not require it to do so, and the state where the exchange is located may (the bill states) pass a law forbidding it to do so—then the insurer must collect from each enrollee (regardless of sex or age) a separate payment to cover abortion. The insurer must keep this pool of money separate to ensure it won't be commingled with so much as a nickel of government subsidy. (This is on Pages 2072-2074.) Our nation has a rare and historic opportunity to expand coverage to tens of millions of people, make coverage more affordable for all families, and crack down on many of the most harmful practices of the health insurance industry. We are writing because of our concern about the lack of clear and accurate information regarding abortion provisions in the health care reform bill passed by the Senate on December 24, 2009. Reforming our health care system is necessarily complex, and the provisions related to abortion, or any other issue, require careful examination of the facts as they exist in the legislative language. We believe that the provisions below provide extensive evidence that longstanding restrictions on federal funding of abortion have been maintained. Following is a comprehensive factual listing of all provisions related to abortion and positive supports for pregnant women in HR 3590, along with specific page references. Abortion-Related Provisions Included in the Senate-Approved Health Care Reform Bill “Patient Protection and Affordable Care Act” (HR 3590 EAS/PP) · Prohibits the Secretary of HHS from requiring the coverage of any abortion services as part of the essential health benefits for any qualified health plan offered in a state insurance Exchange (pg. 2070); · Allows the insurance company to decide whether or not to include coverage of abortion services, including the Hyde abortion exceptions, in a qualified health insurance plan offered in a state insurance Exchange (pg. 2070); · Prohibits insurance companies from using federal funds, including federal tax credits and cost-sharing assistance, to pay for abortion services except for those services allowable under the Hyde amendment (pg. 2071); · Requires an insurance company that chooses to offer a plan in a State Exchange with abortion coverage, beyond the Hyde abortion exceptions, to collect a separate second premium payment from each enrollee for the cost of the abortion coverage (pgs. 2071-2072 & 2074-2075); · Requires the insurance company to deposit all separate payments into a separate account that consists solely of abortion premium payments and that it is used exclusively to pay for such services (pgs. 2072-2074); · Requires the state health insurance commissioners to ensure that insurance companies comply with these requirements in accordance with guidance and accounting standards set by the Office of Management and Budget and the Government Accountability Office (pg. 2075); · Requires insurance companies that offer general abortion coverage as part of a qualified health plan to provide a notice of coverage in the summary of benefits and coverage explanation (pg. 2076); · Allows states to pass a law prohibiting the inclusion of abortion coverage in plans offered in a state health insurance Exchange (pg. 2069); · Requires the director of the Office of Public Management to ensure that there is at least one private, multi-state qualified health plan offered in each state insurance Exchange that does not provide coverage of abortion services beyond the Hyde exceptions (pgs. 2087-2088); · Prohibits insurance companies offering qualified health plans from discriminating against any individual health care provider or health care facility because of its unwillingness to provide, pay for, provide coverage of, or refer for abortions (pg. 2076); · Prohibits the preemption of state laws regarding abortion (pg. 2077); · Maintains current Federal laws relative to conscience protection; willingness or refusal to provide abortion; and discrimination on the basis of the willingness or refusal to provide, pay for, cover, or refer for abortion or to provide or participate in training to provide abortion (pg. 2077); · Establishes and provides $250 million for programs to support vulnerable pregnant women (pgs. 2170-2173); and · Increases the adoption tax credit and makes it refundable so that lower income families can access the tax credit (pgs 2400-2407).
