<![CDATA[ WASHINGTON (Dow Jones)--U.S. regulators closed five more banks in four states Friday evening, as a still-weak economy continues to batter the banking industry. <br> <br> Federal regulators said banks in Georgia, Florida, Washington and Oregon have failed, bringing the 2010 total to 108. The pace of failures so far this year far outstrips that of 2009, which still saw high numbers of closures. At this point last year regulators had shuttered 69 banks. <br> <br> The Federal Deposit Insurance Corp. said the five failures would cost its insurance fund nearly $335 million. <br> <br> The largest failure occurred in Oregon, where Eugene-based LibertyBank was seized by regulators. The bank had total assets of $768.2 million and total deposits of $718.5 million as of the end of March. <br> <br> The FDIC said Home Federal Bank, based in Nampa, Idaho, agreed to assume all of the failed bank's deposits and purchase approximately $419.7 million of its assets. <br> <br> Also out west, regulators closed the Cowlitz Bank, in Longview, Wash., which had $529.3 million in assets and $513.9 million in deposits as of the end of March. Cowlitz had nine branches, including two in Oregon and three in Washington operating under the name Bay Bank. <br> <br> Regulators said that Olympia-based Heritage Bank had agreed to assume all of the deposits and purchase $329.5 million of the failed bank's assets. The FDIC will retain the rest of the assets from the failed bank, to sell later. <br> <br> Two banks in Florida failed, with Centennial Bank, of Conway, Ark., agreeing to assume all of the deposits and essentially all of the assets of both. <br> <br> The Florida Office of Financial Regulation seized Panama City Beach-based Coastal Community Bank, which had $372.9 million in assets, $363.2 million in deposits and 11 branches. <br> <br> The Office of Thrift Supervision seized Port Saint Joe-based Bayside Savings Bank, which had $66.1 million in assets, $52.4 million in deposits and two branches. OTS said that Bayside Savings Bank was closed because it was "undercapitalized, with no reasonable prospect of becoming adequately capitalized." <br> <br> Regulators also seized NorthWest Bank and Trust of Acworth, Ga., which had approximately $167.7 million in assets and $159.4 million in deposits as of March 31. <br> <br> The Federal Deposit Insurance Corp. arranged for Macon-based State Bank and Trust Co. to assume all of the failed bank's deposits and essentially all of its assets. <br> <br> Separately, the FDIC announced Friday that it sold securities backed by $471.3 million of performing single-family mortgages from 16 failed banks. The agency said the pilot program is the first time it has sold assets in a securitization "in the current financial crisis." <br> <br> The FDIC has been looking for ways to unload the assets it has acquired from taking over hundreds of failed banks since 2007. Don't believe <br> This fairy tale was re-told most recently by Republican National Chairman Ed Gillespie when he said in a Dec. 3 speech: “80% of the tax relief for upper income filers goes to small businesses.” It’s untrue – and a classic example of a statistical distortion gone amok. <br> It may be true that 79% of upper-income taxpayers have some income from business, but Gillespie’s definition of “small” business actually includes big accounting firms, law firms and real-estate partnerships, and “businesses” that are really only sidelines – such as occasional rental income from a corporate chief’s ski condo. In fact, tax statistics show that upper-income taxpayers get far more of their income from salaries, capital gains, stock dividends and interest than they do from small business. <br> Analysis <br> By twisting statistics and over-hyping, Republicans are spoiling for themselves what would otherwise be a perfectly serviceable argument: lowering taxes on the most affluent Americans does indeed lower taxes on many small businesses, and thus creates more jobs. But not nearly as many as Gillespie and some other Republicans are claiming. <br> It is undisputed that that many small-business owners report profits from their companies on their personal income-tax returns and not on corporate returns. It’s also true that small business is a major source of new jobs, and economists generally agree that lower business taxes eventually tend to produce more hiring. So cutting the top tax rate probably does stimulate some small-business hiring. But how much? Then the report made a huge leap, claiming “These small business owners would receive 79 percent of the … tax savings” from cutting the top tax rate. But wait a second – very few of those “small business owners” are really running dry-cleaning stores. A Republican committee staff member confirmed to FactCheck.org that their report is counting anybody who made even one dollar of profit from a hobby business as a “small business owner” if they reported that income on Schedule C of their federal income-tax returns. <br> <br> Their method also counts as a "small business owner" any member of an investment club -- someone who put $50 a month into a pool to buy stocks with friends and then reported a few dollars of dividends and capital gains on a K-1 form from the partnership at the end of the year. <br> <br> And that’s not all. According to an analysis by the nonpartisan Tax Policy Center, done at the request of FactCheck.org, business income accounts for just over 22% of the income that will be reported this year by the most affluent American households. Those upper-income taxpayers actually get more from interest, dividends and capital gains than they get from business income, but Gillespie said nothing of the tax benefits on that score. <br> <br> Both the Republican study and the Tax Policy Center focused on the same group of elite taxpayers -- those paying the top income-tax rate. (That's the rate which dropped to 35% this year from the previous level of 38.6% under the most recent tax cut.) In an earlier look at the same group, the Tax Policy Center found that roughly three out of four taxpayers paying the top rate got less than half their income from business. <![CDATA[Back in May there was a report on what seemed to be a fake tea party group circulating petitions in the state of Michigan to get themselves recognized as an official political party. <br> <br> The group circulating the petition, Progressive Campaigns, Inc., had long-time connections to the Michigan Democrat Party and at that time no one in the various Michigan tea party groups had any knowledge of this new so-called Tea Party petition effort. <br> <br> Now the Detroit Free Press is reporting that a United Auto Workers union member named Mark Steffek has filed papers with the state announcing that this so-called Tea Party has had a "convention" and is fielding a slate of candidates for the 2010 elections. <br> <br> One thing is odd about this supposed slate of candidates from this new "Tea Party" political party, though. It appears that the only places that the new party is fielding candidates just happens to be in districts where Republicans just might pick up a seat. <br> <br> That's right the only place that this new party is fielding a candidate is where their interference as a fake "tea party" candidate might cause the Republican to lose and the Democrat to retain a seat. <br> <br> I'm sure this is all just an accident right? <br> <br> Obviously this fake Tea Party is a Democrat dirty trick fronted by a union hack organized to defeat insurgent Republicans in a year when the GOP is growing in support. His tax cuts and supply side economics created the largest period of growth in American history. To say the tax cuts created the deficit is infantile thinking. The tax cuts created revenue, increased revenue. Increased spending created the deficit. had the Bush tax cuts not gone into effect, Obama would have inherited a depression, that started in the Clinton administration. The economy was already showing signs of slowing before Bush took office. Couple that with 09/11 and the dramatic effect it had on our economy and the retaliation against terrorism in response, and I would argue Bush was an economic genius compared to the organizer and his tax fraud administration. He places children, in family law cases, with abusers, pimps, prostitutes, drug users and abusers, transients, and worse. He's on WTV right now lying and being a hypocrite, talking about the rights of criminal defendants and evidence and a fair trial. But, in family law matters, that's out the window. He doesn't care about evidence of a neglectful abusive parent, or if that parent has an abusive, criminal, violent new lover living with them. He, in fact, is a child abuser himself because he has control of where a child is placed and who a child is protected from and he puts children in the "lion's den" of abusers by his decisions. Whether or not he is in bed with radical feminists, takes money from them, or is brainwashed to think all fathers are bad is beyond the point. The next several weeks, leading up to the November elections, are sure to be filled with resounding political invective over who should pay for Washington's profligate spending over the last decade. Democrats will argue that the rich and near-rich should pony up, since they have the most money to start with. Republicans will point to the needy, arguing that they've been getting too much aid for too long. Tea Partiers will struggle to decide whose benefits should be cut in order to achieve the smaller government they envision. All around, livelihoods will be threatened. Instead of the "silly season," the midterm elections will feel like the angry season. <br> <br> [See how to prepare for a double-dip recession.] <br> <br> It sounds very entertaining. But if you'd rather stick your fingers in your ears until November 3, feel free: For all the shouting that's on the way, it's not hard to predict what's going to happen. <br> <br> Tax policy over the last 20 years has swung left and right based on the ideology of the governing party. But America can no longer afford the luxury of a manic tax code driven by what the party in power thinks is fair. Instead, simple math is now taking over. Revenue from individual income taxes, for example, was relatively stable between 1970 and 2000, ranging from about 8 to 10 percent of GDP, according to the Congressional Budget Office. After the Bush tax cuts of 2001 and 2003, that figure fell to a record low of about 7 percent. The late, great recession drove it even lower. <br> <br> If federal spending had fallen by a similar amount during the last decade, President Obama might be able to extend all those tax cuts once they expire at the end of this year, and declare America Low-Tax Nation. But of course government spending has gone up and up, thanks to two overseas wars, skyrocketing Medicare and Medicaid costs, and a brutal recession that drove tax revenue down at the same time the government spent more than $1 trillion in stimulus aid. The resulting federal debt, about $14 trillion, is now as big as the entire economy. If it continues to mushroom as forecast, the debt will eventually crush us all via rising interest rates, stagnant growth, and pure shame. <br> <br> [See 10 states where taxes are up, services down.] <br> <br> It's the job of Obama and his fellow politicians to make sure that doesn't happen, and they're thinking about getting around to it some day, maybe. Most economists feel the solution is a combination of tax increases and spending cuts, since doing one or the other alone would be too draconian to disguise with the usual opposite-speak out of Washington. The first real opportunity to do something arises this fall, since income taxes for most Americans will automatically go up unless Congress and Obama extend some of the Bush tax cuts. Here's what's likely to happen: <br> <br> Wealthy taxpayers are going to pay more. Obama wants to raise the top two income brackets from the Bush-era levels, which means the top rate will rise from 35 to 39.6 percent and the rate in the next bracket will rise from 33 to 36 percent. That effectively means that taxes will rise for individuals with income over $200,000 and couples earning over $250,000 (after accounting for deductions). There will also be new limits (same as the old ones, before the Bush cuts were enacted) on the total amount of allowable deductions, which will bump a few additional people into these higher brackets. To enact these "tax hikes" on the wealthy, Congress doesn't need to do anything--it will happen automatically at the end of 2010, once the Bush tax cuts are over. <br> <br> [See 4 things financial reform won't do for you.] <br> <br> There's a lot of "debate" about this, but for the Democrats who control Congress, the political calculus is irresistible. Those who would fall into the two higher brackets account for just 3.4 percent of all taxpayers, according to the Tax Policy Center, and those people tend to be Republicans anyway. So few Democratic votes would be at stake. And Republicans themselves have been bellyaching about how important it is to start attacking the debt. Republicans counter by arguing that enacting any tax increase in a weak economy is dangerous, because it could crimp spending just when it's needed most. There's truth to that, but the majority of evidence suggests that tax increases on the wealthy would cut into what they save, not what they spend. The media will treat this whole issue as a huge drama, but the fact that a Democratic Congress would have to pass a new law to prevent higher taxes on the wealthy weighs heavily in favor of a tax increase. Call your accountant. <br> <br> The middle class will get a temporary pass, but it will only defer the inevitable pain. Obama has pledged no new taxes on the middle class, and no matter how implausible that is, it's hard to see him breaking that promise in his first term. Besides, raising the income tax rates on the majority of taxpayers would be risky in a lousy economy, so the odds are high that Congress will extend the Bush tax cuts for those who fall below the $200,000/$250,000 thresholds. The Senate, which moves slower than the House, may not get to that before the November elections, so the action may come in the lame-duck session that follows, leading to plenty of high-volume gamesmanship right up until the elections. One reasonable guess is that the Bush cuts will be extended by only two years, forcing Washington to deal with them again in 2012--when the economy, presumably, will be stronger. At that point or soon after, Congress will have to get serious about new taxes--and there aren't nearly enough wealthy Americans to finance a solution, at any tax rate. "We've been selling government services at 80 to 90 percent of their cost," says Clint Stretch, managing principal for tax policy at Deloitte Tax. "We're going to have to start selling them at a premium to pay for the discounts in the past." <br> <br> Possibilities include not just higher tax rates on those who already pay, but a host of scaled-back deductions--including the mortgage-interest deduction for home purchases--and a new value-added tax that could raise the cost of most goods and services. Exemptions for lower-income workers could be narrowed as well, so more people pay taxes. The tumult will be fascinating, since voters are likely to revolt no matter how bankrupt American becomes or what is fiscally prudent. This was part of the 2009 stimulus plan that reduced the tax burden for individuals by $400 and for couples by $800, up to income thresholds of $95,000 and $195,000. It was initially put into effect for 2009 and 2010; Obama wants to extend it through 2011, and he'll probably get his wish. The tax credit benefits about three-quarters of all taxpayers, and can plausibly be counted as additional "stimulus" that will help the economy recover. So it has popular appeal despite an estimated cost of about $60 billion in lost government revenue for each year it's in effect. There are two basic issues: What the tax rate should be, and what portion of an estate should be exempt from taxes before the government takes its share. Most proposals are coalescing around an exemption of between $3.5 million and $5 million, and tax rates that range from 35 to 50 percent after that. Conservatives loathe the "death" tax, complaining that it's a second levy on money's that already been taxed once. But unbeknownst to them, lean times have turned public opinion squarely against the super-rich, who are the only ones really affected by estate taxes. After the 2010 holiday, a reinstatement seems inevitable. <br> <br> The real battle over higher taxes and lower spending will probably kick off following the 2012 elections. "The choices are all very, very ugly," says Stretch. The first part of any serious effort would probably be sharp spending cutbacks, which have to affect Social Security and Medicare recipients if they're going to be meaningful, since that's where much of the money goes. First up, global warming: <br> <br> Didier came out at as a global warming skeptic, citing hacked e-mails from gossipy scientists at a British university, and saying science has been "altered" so as "to make it look like it is truly happening." <br> "They say the glaciers are shrinking but with information I'm receiving, it seems clear that the (Arctic) ice is reforming and expanding," he said. <br> <br> So in what line of work does Didier encounter such sensitive, contrary information? Patty Murray (D-Wash.) will likely prompt Democrats to question his relationship to a Bellevue, Wash. bank that has run into problems with federal regulators over low capital ratios and lending practices.... <br> <br> [H]e was a co-founder, investor and the man who wooed the bank’s acting CEO, Dick Ducharme, a friend, lobbyist and business partner, to invest, according to press accounts. As of 2007, Rossi, a former State Senator, had a stake in the bank of at least $75,000, which is the maximum amount that could be listed on a legislative disclosure form. <br> <br> Eastside, like dozens of other small banks in the Northwest, has been sunk by sour deals. Last year, the federal Comptroller of the Currency, which monitors capital ratios, declared Eastside had "engaged in unsafe and unsound banking practices relating to its strategic and capital planning, credit underwriting, credit administration, concentration risk management, and liquidity management." <br> <br> ..."I guess this is one of the issues they've been trying to bring up... and this stuff is not sticking," said Peter Cowman, spokesman for the Washington State GOP. "Dino is a small investor in this local community bank that gives out loans to small businesses and things like that... He's never been on the board and hasn’t been an officer with the bank... These attacks are pretty low." <br> <br> They may be low, but there sure are a helluva lot of them. There's just a persistent sheen of sleaze to Rossi that seems to have solidified in the six years since he failed in his bid to become governor. The Washington GOP, and maybe even Rossi himself, must figure that the sheen is Teflon, and won't hurt him. Chances are, they're far less concerned with the sleaze factor than with the little problem he has with the teabaggers. Goldy posts a snippet from Washington's News Tribune: <br> <br> Rossi is considering whether to enter the race against Sen. Patty Murray. One of a long roster of less well-known Republicans seeking to unseat Murray, former NFL tight end Clint Didier, last weekend said tea party activists would reject Rossi. And no candidate will win without their backing, he said. <br> <br> Pierce County Tea Party member Lawrence Hutt agrees, though he supports a different candidate for Senate, Sean Salazar. <br> <br> “Rossi is too establishment to get the tea partiers all fired up,” said Hutt, a paralegal from Wauna. “He’s not going to fan the flames of any tea partiers I know.” <br> <br> As Goldy points out, the only way Patty Murray is vulnerable in November is if there is a huge enthusiasm imbalance, and to dislodge Murray, it'd have to be pretty damned big. <![CDATA[ <br> Dino Rossi’s Moral Hazard <br> by Goldy, 05/12/2010, 9:06 AM <br> <br> When I wrote a post back in March, laying out Dino Rossi’s shady business dealings with accused swindler Michael Mastro, Rossi’s defenders depicted the maybe-senatorial candidate as one of Mastro’s victims. When a real estate investment firm Rossi co-owns was found to owe over $20,000 in unpaid property taxes, Rossi’s business partners downplayed his culpability, saying “It definitely is nothing Dino is involved in.” <br> <br> And Monday, when Politico reported that a failing bank Rossi co-founded and co-owns runs the risk of being shut down by the feds at taxpayer expense, a Washington State Republican Party spokesperson laughed off Rossi’s involvement, repeating the Rossi-as-victim meme by saying of his investment, “It’s not worth as much as it used to be.” <br> <br> All of which raises a question: If Rossi — who frequently touts his business acumen and experience as one of his prime qualifications for higher office — is so hands off his investments, so easily swindled by his associates and so frequently on the wrong end of a deal gone bad, can we taxpayers really afford to have Rossi run government like he runs his business? <br> <br> Or, is Rossi really much more involved with his business dealings than he lets on? <br> <br> He’s allegedly a millionaire after all, so it’s hard to believe that Rossi is as clueless and detached as his surrogates consistently make him out be. Take, for example, the foundering Eastside Commercial Bank at the center of the latest expose. Rossi was one of 35 founding stakeholders who put in a minimum of $10,000 each to start up the venture, and it was Rossi who recruited Dick Ducharme, “a friend, lobbyist and business partner” to both invest in the bank and serve as its CEO. <br> <br> So, when the federal Comptroller of the Currency declares that Eastside has “engaged in unsafe and unsound banking practices relating to its strategic and capital planning, credit underwriting, credit administration, concentration risk management, and liquidity management,” doesn’t that even somewhat reflect on Rossi’s judgement, if not his business ethics and management skills? <br> <br> Rossi’s defenders insist “no,” dismissing this latest revelation as just another skid-mark in a Democratic smear campaign, but one can’t help but wonder if Rossi’s refusal to take any personal responsibility for the negative consequences of his own business ventures might have contributed to their failure? No doubt Rossi helped start the Eastside Commercial Bank with the intent of getting in on the huge profits that were being made during the recent real estate bubble, but now that it is collapsing under the weight of the same kind of “unsafe and unsound banking practices” that were widespread in the industry at the time, Rossi expects to be held blameless for his own co-creation. <br> <br> This is exactly the sort of moral hazard that led to the Wall Street disaster and subsequent bailout, for when there are no consequences for one’s actions, or when the consequences are always the responsibility, perceived or otherwise, of some third party, then there is little disincentive to reckless behavior or benign neglect. And while the term has most recently been applied to the machinations of Wall Street, it is just as applicable to the way Rossi routinely leverages his political capital for both political and personal gain, apparently without fear of ever being held publicly responsible for his actions. <br> <br> Rossi could have accepted at least a little responsibility for the unsound practices of the bank he co-founded, just like he could have accepted responsibility for not seeing through the fraudulent practices of his mentor Mel Heide or his investment partner Michael Mastro. He could have accepted responsibility for being a partner in a business that failed to pay its taxes, or for his gubernatorial campaign’s misuse of the Everett AquaSox mailing list, a team he part-owned. But in all these situations he allowed the blame to fall on others, painting himself the innocent victim of a Democratic smear campaign. <br> <br> The thing is, it’s not a smear when it’s the truth. Rossi’s mentor was convicted of fraud, and Mastro is accused likewise. Rossi did misuse the AquaSox mailing list, his business did fail to pay its taxes, and his bank is on the verge of collapse. I suppose you could argue that it is unfair of me to imply guilt by association, but it is not unreasonable to attempt to infer a pattern by connecting the dots. <br> <br> More troubling though for Rossi and his boosters at the NRSC is that the dots keep coming, and it is important to note that despite the vetting he received during his two gubernatorial runs, these latest revelations involve post-2008 timelines. This is the way Rossi conducts his business, and if he truly is as hands-off a manager as his defenders insist, or as morally hazardous as critics like me suspect, then dollars to donuts there are plenty more dots to come. <br> ]]>

With that in mind, alarm bells began ringing in my head when I read this Washington Times report about Jacob Lew, Obama’s nominee to head the Office of Management and Budget. <br> <br> Why did Citigroup decide to hire a career DC political operator for $1.1 million? As a former political aide, lobbyist, lawyer, and political appointee, what particular talents did he have to justify that salary to manage an investment division? Did the presence of Lew (as well as other Washington insiders such as Robert Rubin) help Citigroup get a big bucket of money from taxpayers as part of the TARP bailout? Did Lew’s big $900K in 2009 have anything to do with the money the bank got from taxpayers? <br> <br> Is it a bit suspicious that he received his big windfall bonus four days after filing a financial disclosure? Read this blurb from the Washington Times and see if you can draw any conclusion other than this was a typical example of the sleazy relationship of big government and big business. <br> <br> President Obama’s choice to be the government’s chief budget officer received a bonus of more than $900,000 from Citigroup Inc. last year — after the Wall Street firm for which he worked received a massive taxpayer bailout. The money was paid to Jacob Lew in January 2009, about two weeks before he joined the State Department as deputy secretary of state, according to a newly filed ethics form. The payout came on top of the already hefty $1.1 million Citigroup compensation package for 2008 that he reported last year. <br> <br> Administration officials and members of Congress last year expressed outrage that executives at other bailed-out firms, such as American International Group Inc., awarded bonuses to top executives. State Department officials at the time steadfastly refused to say if Mr. Lew received a post-bailout bonus from Citigroup in response to inquiries from The Washington Times. But Mr. Lew’s latest financial disclosure report, provided by the State Department on Wednesday, makes clear that he did receive a significant windfall. …The records show that Mr. Lew received the $944,578 payment four days after he filed his 2008 ethics disclosure. <br> <br> Lest anyone think I’m being partisan, let’s now look at another story featuring Senator Richard Shelby. The Alabama Republican and his former aides have a nice incestuous relationship that means more campaign cash for him, lucrative fees for them, and lots of our tax dollars being diverted to moochers such as the state’s university system. Here are some of the sordid details. <br> <br> Since 2008, Alabama Sen. Richard Shelby has steered more than $250 million in earmarks to beneficiaries whose lobbyists used to work in his Senate office — including millions for Alabama universities represented by a former top staffer. In a mix of revolving-door and campaign finance politics, the same organizations that have enjoyed Shelby’s earmarks have seen their lobbyists and employees contribute nearly $1 million to Shelby’s campaign and political action committee since 1999, according to federal records. …Shelby’s earmarking doesn’t appear to run afoul of Senate rules or federal ethics laws. But critics said his tactics are part of a Washington culture in which lawmakers direct money back home to narrow interests, which, in turn, hire well-connected lobbyists — often former congressional aides — who enjoy special access on Capitol Hill. <br> <br> Some people think the answer to these stories is more ethics laws, corruption laws, and campaign-finance laws, but that’s like putting a band-aid on a compound fracture. Besides, it is quite likely that no laws were broken, either by Lew, Citigroup, Shelby, or his former aides. This is just the way Washington works, and the beneficiaries are the insiders who know how to milk the system. The only way to actually reduce both legal and illegal corruption in Washington is to shrink the size of government. The sleaze will not go away until politicians have less ability to steer our money to special interests – whether they are Wall Street Banks or Alabama universities. ]]>

It'll manage various slush funds underwriting more Acorn-type housing activism. <br> <br> Housing and Urban Development is one of two federal agencies regulating Fannie Mae and Freddie Mac, with HUD supervising the mortgage giants' congressionally chartered "affordable housing" mission. <br> <br> In the run-up to the subprime crisis, HUD gutted underwriting standards at Fannie and Freddie to help them meet a 50%-plus affordable lending quota. HUD also authorized the now-toxic twins to receive credits toward these affordable-lending goals by purchasing and issuing subprime securities. <br> <br> So HUD not only drove Fannie and Freddie headlong into the subprime market, but also helped create the subprime securities market, thereby spreading the mortgage-backed securities risk on Wall Street. Its relationship with Fannie and Freddie won't change under the new law. FinReg doesn't rein in HUD, just like it doesn't rein in Fannie or Freddie. <br> <br> Far from reforming HUD, the new law gives the agency even more power over the housing industry — including setting up new grant programs that will funnel billions of dollar in aid to the same housing-rights activists and community organizers that originally pushed lenders off the subprime cliff. <br> <br> The Dodd-Frank Wall Street Reform and Consumer Protection Act — named after HUD's biggest boosters in the Senate and House — authorizes HUD to set up: <br> <br> • A housing "stabilization program" for redeveloping urban neighborhoods, with funding starting at $1 billion. <br> <br> • A "legal assistance" program providing grants to housing advocates for poor and minority homeowners at risk of defaulting on their mortgages. <br> <br> • A "housing counseling" program serving "low-income minority communities" and "persons who face language barriers," with a budget running in the hundreds of millions. <br> <br> Only HUD-certified agencies get to do the counseling. Who are they? The new law defines them as "community-based organizations with expertise in the field of housing counseling" (even though studies show such counselors do little to prevent reckless borrowing). <br> <br> Before the subprime crisis, Acorn was a HUD-certified agency. So was the Neighborhood Assistance Corp. of America, whose founder is a self-described anti-bank "terrorist." Another HUD partner is the Border Fair Housing & Economic Justice Center, which promotes "affordable housing" for Mexican immigrants, including illegal aliens. <br> <br> These are not temporary programs. Community organizers will demand they stay fully funded, indefinitely. They are destined to grow into bureaucratic fiefdoms. <br> <br> And grant money won't go directly to homeowners. It will be funneled through community organizers, who in turn will have new license to orchestrate corporate shakedowns. Another easy-credit frenzy lurks around the corner. <br> <br> FinReg also authorizes HUD's secretary to establish a multiyear program of grants to community banks to "enable low- and moderate-income individuals to establish one or more accounts in a federally insured depository institution." <br> <br> Qualifying banks, in turn, will offer "small-dollar value loans" — not exceeding $2,500 — as "alternatives to more costly payday loans" commonly used by Hispanic day laborers. <br> <br> According to the law, this new HUD slush fund will help community banks "defray the costs of operating small-dollar loan programs by providing the amounts necessary for such institutions to establish their own loan-loss reserve funds to mitigate some of the losses on such small-dollar loan programs." <br> <br> In other words, HUD will now encourage such banks to cater to illegal immigrants while taxpayers subsidize their losses. <br> <br> Didn't hear about this redistribution plan? The White House has hosted some of the most prominent business leaders over the past month. It has pledged "an open door" and solicited their input and ideas. Meanwhile, top representatives of the White House have made their rounds on financial television and Sunday talk shows to put a business-friendly gloss on the administration's controversial economic program. <br> <br> The problem for the White House is that its PR push is not backed up with any substance — and words are no substitute for deeds. How could anyone construe this as a sincere effort to encourage new investment and job creation — or, much less, to reassure businesses of all sizes that they won't be hit with massive new tax hikes at the end of the year? <br> <br> Businesses won't simply forget the damage done over the past 18 months. What the bill won't do is bring transparency to the government regulators of the financial markets. <br> <br> The U.S. Securities and Exchange Commission (SEC) has been exempted from almost all Freedom Of Information (FOI) requests by the "financial reform" bill. This is what the Obama administration means by transparency: A business should record and report every minute detail, save every document, on the other hand the government body that oversees the regulation of business has almost no public accountability at all. <br> <br> The stunningly bad idea of providing legal cover for a regulating body that has a history of getting it wrong is par for the course when it comes to "financial reform". Remember, this is the same SEC that failed to get Bernie Madoff; does anyone think that exempting them from public disclosures is going to make the institution work any better? The Dodd-Frank bill removes transparency from the regulators at the SEC, making it harder for the public to know if their tax dollars are being spent wisely <br> <br> This isn't the only bad idea in the 2000 plus page Dodd-Frank monstrosity, but what isn't in the bill is just as disconcerting. The Dodd-Frank bill fails to regulate Fannie Mae and Freddie Mac, the two Government Sponsored Entities that were at the heart of the financial meltdown. Currently Fannie and Freddie have more than $5 trillion in liabilities, and have already cost the US taxpayer $150 billion dollars. The two GSEs (government-sponsored enterprises) have been involved in numerous accounting scandals where investigators found "extensive financial fraud." Yet these two companies are exempt from Dodd-Frank's "financial reform"! <br> <br> Remember it was these same two GSEs that bundled so many mortgages and sold them to Wall Street. With this history, the Democrats have decided to regulate Wall Street, not Fannie and Freddie. Not surprisingly, Democrats in Congress received a majority of the political contributions from Fannie and Freddie. <br> <br> Currently Fannie and Freddie are being operated by the federal government and were ordered delisted from the New York Stock Exchange. It's worth reminding Democrats that the only thing that their continued meddling in the market place has wrought is failure. The Dodd-Frank bill protects the politically connected democratic creations of Fannie, Freddie, and the SEC, while providing a public whipping boy in Wall Street. <![CDATA[change: <br> <br> Here are 13 changes in the massive overhaul that could impact your tax bill, for better or worse. <br> <br> By Joan Pryde, Senior Tax Editor, the Kiplinger letters <br> April 5, 2010 <br> <br> This is an updated version of a March 23 story, incorporating the final changes signed into law by President Obama on March 30, 2010. <br> <br> The new health care reform law is chock-full of new taxes and tax increases that will affect many individuals and businesses, but it will be years before most of these hikes take a bite out of your -- or your company’s -- wallet. The law also has tax breaks to help both individuals and small businesses pay for insurance. <br> <br> <br> 1. A new 10% excise tax on indoor tanning services on services provided after June 30, 2010. <br> <br> 2. The new law gives small firms tax credits as incentives to provide coverage, starting this tax year. Employers with 10 or fewer workers and average annual wages of less than $25,000 can receive a credit of up to 35% of their health premium costs each year through 2013. The credit is phased out for firms larger than that and disappears completely if a company has more than 25 employees or average annual wages of $50,000 or more. <br> <br> Beginning in 2014, the system changes. The law requires each state to establish a health insurance exchange -- a marketplace where individuals, the self-employed and small businesses can buy health insurance coverage. The government-regulated exchanges would offer insurance policies with different levels of coverage and price tags. Small firms that sign up with one of the health exchanges to be created can receive a credit of up to 50% of their costs -- with the same phaseouts for average income and size as the earlier program. The credit disappears after 2015. <br> <br> 3. A requirement that businesses include the value of the health care benefits they provide to employees on W-2s, beginning with W-2s for 2011. The amount reported is not considered taxable income. <br> <br> 4. Elimination of a deduction employers now take for providing Medicare Part D prescription drug coverage to their retirees to the extent that the federal government subsidizes the coverage. This will not take effect until 2013. <br> <br> 5. Doubling the penalty for nonqualified distributions from health savings accounts, to 20%, beginning in 2011. <br> <br> 6. A limit on the amount that employees can contribute to health care flexible spending accounts to $2,500 a year, but the cap won’t take effect until 2013. This was previously left to the employer's discretion, with many firms choosing a limit of $4,000 to $5,000 or so <br> <br> 7. A ban on using funds from flexible spending accounts, health reimbursement arrangements or health savings accounts for the cost of over-the-counter medications, starting in 2011. <br> <br> 8. Starting in 2013, a 0.9% Medicare surtax will apply to wages in excess of $200,000 for single taxpayers and over $250,000 for married couples. Also, for the first time ever, a Medicare tax will apply to investment income of high earners. The 3.8% levy will hit the lesser of (1) their unearned income or (2) the amount by which their adjusted gross income exceeds the $200,000 or $250,000 threshold amounts. The new law defines unearned income as interest, dividends, capital gains, annuities, royalties, and rents. Tax-exempt interest won’t be included, nor will income from retirement accounts. <br> <br> . <br> 9. A hike in the 7.5% floor on itemized deductions for medical expenses to 10%, beginning in 2013. But taxpayers age 65 and over are exempt from the cutback through 2016. <br> <br> 10. A new 40% excise tax, beginning in 2018, on high-cost health plans, levied on the portion that exceeds $10,200 for individuals and $27,500 for families. The provision is aimed mostly at gold-plated plans offered by employers, although it can affect individual policies <br> <br> 11. A new tax on individuals who don't obtain adequate health coverage by 2014 -- this is often referred to as the individual mandate.. The tax is to be phased in over three years, starting at the greater of $95, or 1% of income, in 2014, and rising to the greater of $695, or 2.5% of gross income, in 2016. <br> <br> 12. Providing a refundable tax credit, once the individual mandate takes effect in 2014, to help low-income folks purchase coverage. To be eligible, a person's household income must be between 100% and 400% of the federal poverty level, generally around $11,000 to $44,000 for singles and $22,000 to $88,000 for families. The credit is a sliding scale, based on income. Low-incomers get a credit for all costs. Then, as income rises, the credit phases out. <br> <br> 13. A nondeductible fee charged to businesses with 50 or more employees if the firms fail to offer adequate coverage. <![CDATA[Second-quarter earnings reports are coming in, and they’re making Wall Street smile. Corporate profits are up. And big American companies are sitting on a gigantic pile of money. The 500 largest non-financial firms held almost a trillion dollars in the second quarter, and that money pile is growing larger this quarter. Profits that plummeted in the recession have bounced back. Big businesses have recovered almost 90 percent of what they lost. <br> <br> So with all this money and profit, they’ll start hiring again, right? Wrong – for three reasons. <br> <br> First, lots of their profits are coming from their overseas operations. So that’s where they’re investing and expanding production. <br> <br> GM now sells more cars in China than it does in the US, but makes most of them there. The company now employs 32,000 hourly workers in China. But only 52,000 GM hourly workers remain in the United States – down from 468,000 in 1970. <br> <br> GM isn’t just hiring low-tech assembly workers in China. Last week the firm broke ground there on a $250 million advanced technology center to develop batteries and other alternative energy sources. <br> <br> You and I and other American taxpayers still own over 60 percent of GM. We bought GM to save GM jobs, remember? <br> <br> GM officials say no American taxpayer money is being used to expand in China. But money is fungible. Because of our generosity, GM can now use the dollars it doesn’t have to spend in the United States meeting its American payrolls and repaying its creditors, for new investments in China. <br> <br> Second, big U.S. businesses are investing their cash in labor-saving technologies. This boosts their productivity, but not their payrolls. <br> <br> Last Friday, for example, Ford reported a $2.6 billion second-quarter profit. The firm is already more than two-thirds the way to equaling its record 1999 profits. But due to labor-saving technologies, Ford now has half as many employees as it did a decade ago. <br> <br> Wall Street analysts are happy with Ford’s “commitment to keeping capacity in check,” according to the Wall Street Journal. Ford shares rose 5.2 percent Friday. “Keeping capacity in check” is the Street’s way of saying “no new hiring.” In fact, the Street is advising investors to sell the stocks of companies that talk openly of expanding capacity. <br> <br> Finally, corporations are using their pile of money to pay dividends to their shareholders and buy back their own stock – thereby pushing up share prices. <br> <br> Last Friday, GE announced it would raise its dividend by 20 percent and reinstate its share-buyback plan. It’s GE’s first dividend increase since the company cut its dividend in early 2009. As a result, GE shares are up more than 5% in the past few days. <br> <br> Bottom line: Higher corporate profits no longer lead to higher employment. We’re witnessing a great decoupling of company profits from jobs. <br> <br> The next supply-side economist who tells you companies need more incentive (i.e. lower taxes) before they’ll hire is living on another planet. <br> <br> The reality is this: Big American companies may never rehire large numbers of workers. And they won’t even begin to think about hiring until they know American consumers will buy their products. The problem is, American consumers won’t start buying against until they know they have reliable paychecks.]]>
